为全面执行国际海事组织A.443(XI)号决议《关于船长在海上安全和海洋环境保护方面的决定权》，公司现就船长的权力强调声明如下:

1.1

授权船长采取一切必要措施，并有绝对权力采取决定性行动，保证海上安全，防止人员伤亡，避免对环境，特别是海洋环境造成危害以及对财产造成损害。

1.2

船长可在任何时候要求公司有关人员提供必要援助以便履行安全和防污染职责。

1.3

在涉及船舶安全和防污染工作中，船上各级人员必须严格服从船长的统一指挥。

1.4

船长为履行海上安全和海洋环境保护方面的职责，有权根据自己的专业判断作出必要的决定，而不受公司各级管理人员、船东、租船人的约束。

1.5

公司保证船长不致因正当履行其职责而遭到船东、租船人或其它任何人不公正的待遇。

In order to ensure the Master perform his right and responsibilities prescribed by the IMO A.443(XI), “DECISIONS OF THE MASTER WITH REGARD TO MARITIME SAFETY AND MARINE ENVIRONMENT PROTECTION, the Company hereby declare the following:

1.1

The Masters shall be empowered to take all necessary measures or have the overriding authority as per IMO A.443(XI) to ensure the maritime safety ,or to prevent personnel losses or injuries, or to prevent the damage of marine environment and property.

1.2

The Masters is entitle to contact at all times with all staff of Company, including CSO, Management Representative (or his nominated person) to obtain adequate assistance if necessary, to perform the responsibilities of the maritime safety and marine environmental protection.

1.3

All crewmembers on board shall strictly follow all the orders and instructions from the shipmasters related with the maritime safety and marine environmental protection.

1.4

The Master is not constrained by the staffs in the Company, charterer or any other person from taking decision regarding the marine safety and environmental protection which, in the professional judgment of the Master.

1.5

The Company shall ensure that the shipmaster do not encounter any unjustifiable dismissal or other unjustifiable action be by the Company, charterer or any other person as a consequence of the proper exercise of his professional judgment.
